On February 26, 2024, the Mediation and Arbitration Information Seminar for Judges held in Ankara was organized with the Turkish Arbitration Academy, of which our University is a stakeholder, within the scope of the "Project for the Development of Alternative Dispute Resolution in Turkey" carried out in cooperation with the European Union, the Council of Europe and the Ministry of Justice.
In the event, where our Faculty of Law Faculty Members Vice Rector Prof. Ali Yeşilırmak, Assoc. Prof. Yeliz Bozkurt Gümrükçüoğlu and Research Assistant Ömer Faruk Kafalı participated on behalf of Ibn Haldun University, Prof. Ali Yeşilırmak emphasized the importance of freedom of will and the right to be heard, which are the most important principles of the Arbitration Procedure, and explained the points that the arbitrators and parties should pay attention to in arbitration proceedings to the audience through court decisions.
The program organized by the Turkish Arbitration Academy, of which we are a stakeholder, was attended by Yılmaz Tunç, Minister of Justice of the Republic of Turkey, Mehmet Akif Ekinci, President of the Presidency of the Republic of Turkey, Deputy President of the CJP, Halil Koç, President of the 1st Chamber of the CJP, William Massolin, Representative of the Council of Europe, high judicial judges and members of parliament.
Yılmaz Tunç, Minister of Justice, Dr. Metin Kıratlı, President of the Presidency of the Republic of Turkey, and William Massolin, Head of the Ankara Programme Office of the Council of Europe Representative to Turkey, delivered welcoming speeches at the opening of the program.
Minister of Justice Yılmaz Tunç stated that investors seek legal security and stability when investing in their businesses, and that a safe, fair and stable investment environment ensures the acquisition of investors. In this context, Tunç stated that the principle of legal security is one of the most important elements that foreign investors look for in the country where they will invest.
Presidential Chief of Administrative Affairs Dr. Metin Kıratlı stated that it is of great importance to increase and expand the use of alternative dispute resolution methods in order to resolve disputes amicably.
Emphasizing that the increased use of arbitration will contribute to a significant reduction in the workload of the courts, Kıratlı stated that it is of great importance for all practitioners as well as judges to know about arbitration and to increase expertise in this field. Prof. Dr. Kıratlı concluded his speech by stating that a working group has been established under the coordination of the Presidency to ensure that the consultations between public institutions regarding arbitration processes are carried out in accordance with their purpose, and that the Presidency of Administrative Affairs is also trying to contribute to the development of arbitration through various publications that can be accessed online through the legislation information system.
In the seminar, which consisted of 4 sessions in total, the participants made presentations on various topics around the main theme.
